Terms of Service

These Terms of Service govern your use of Ironclad Restoration Marketing’s website, client portal, and proposal-and-contract tools. By using the site or accepting a proposal, you agree to these terms. The specific, binding terms of any project engagement are set out in the standard contract terms incorporated into the proposal you sign; where those engagement terms and these site terms conflict, the engagement terms control for that project.

Our services

Ironclad Restoration Marketing provides website design, hosting coordination, and digital-marketing services for restoration businesses. The scope, fees, and deliverables for your engagement are defined in the proposal you receive and accept.

Proposals, e-signature, and contracts

Proposals are delivered through a secure link. When you accept a proposal — by checking the acceptance box and providing your electronic signature — you enter into a binding agreement on the terms stated in that proposal, and our counter-signature is applied automatically to execute it. You agree that your electronic signature has the same legal effect as a handwritten one, and that we may keep the signing record (including timestamp, IP address, and browser details) as evidence of the agreement.

Fees, billing, and cancellation

  • One-time setup charges are billed when you accept your proposal, as shown on that proposal.
  • Recurring monthly services are billed monthly and renew month-to-month until cancelled.
  • The notice required to cancel, and any refund treatment of setup or prepaid amounts, is governed by the standard contract terms in your executed agreement.

Your responsibilities

You agree to provide accurate information and the access credentials and materials we need to perform the services, and that you have the right to share any content, logos, or assets you provide to us. You are responsible for maintaining the confidentiality of your portal login.

Intellectual property

You retain ownership of the content and brand assets you provide. Ownership of the work we produce for you is governed by your engagement terms. Our own software, templates, and site remain our property.

Disclaimers and limitation of liability

The site and services are provided on a commercially reasonable basis without warranties of any kind except as expressly stated in your engagement terms. To the fullest extent permitted by law, and except as your executed agreement provides otherwise, Ironclad Restoration Marketing is not liable for indirect, incidental, or consequential damages arising from use of the site or services.

Changes to these terms

We may update these terms from time to time. Material changes will be reflected by the “last updated” date above, and continued use of the site after a change constitutes acceptance of the updated terms.
